Robbery is distinguishable from other theft crimes for its use of force or intimidation as a means of unlawfully procuring someone's personal property from their immediate presence. California courts have generally held that "immediate presence" includes any property that is within the victim's sight or hearing. Any property that is taken from the victim's immediate presence without their knowledge is usually charged as burglary, which is a less-serious offense than robbery.
The state of California places robbery crimes into two categories: first degree and second degree. As you might expect, first degree robbery is the more serious of the two.
Robbery that does not fit any of the scenarios listed above is generally charged in the second degree. First degree robbery is punishable by up to nine years in prison; second degree robbery is punishable by up to five years.
