What is a Probation Violation?


When a California criminal defendant is serving probation, there are rules that must be followed.  If any of these rules are broken during the probationary period, a probation violation occurs, which could result in the following consequences:

What is Expungement of Criminal Record?

A person who has successfully completed probation can  have the accusations against him or her dismissed and shall be released from all penalties and disabilities resulting from the offense, except as specified by law. Expungement means going to court and asking the court to clear your record so that you can have the peace of mind when applying for new jobs and moving ahead in your life.

Once expungement is granted, you can truthfully assert that you have not been convicted of that offense. There are some exceptions: This does not relieve you of the obligation to disclose the conviction in response to any direct question contained in any questionnaire or application for public office, for licensure by any state or local agency, or for contracting with the California State Lottery. However, the benefits of obtaining this relief far outweigh the exceptions.

A juvenile record can also be sealed through the juvenile court. Certain felony convictions can be reduced to a misdemeanor and then expunged.
